TERMS AND CONDITIONS

These General Terms and Conditions of Sale are intended to govern relations between La VARENNE, a simplified joint-stock company with a capital of 100 euros whose head office is located at 9 rue Victor Petin, 55000 Haironville, registered under number 884 929 357 RCS Bar- le-Duc, and people wishing to benefit from accommodation services and any “à la carte services” within the tourist accommodation “La Petite Varenne”, located at 11 rue Victor Petin, 55000 Haironville, furnished house, such as described below.

The Customer declares to use the site in accordance with the General Conditions of Sale, in his name and/or in the name and on behalf of any final beneficiary of whom he expressly acknowledges being the agent.

These General Terms and Conditions of Sale are therefore enforceable against the Customer and any final beneficiary.

A website is available at the address www.lapetitevarenne.com, through which furnished rentals are offered, possibly supplemented by certain paid à la carte services.

Any reservation implies the unconditional acceptance of these General Conditions of Sale.

The customer confirms his agreement to these by ticking the box provided for this purpose on the online booking form.

A copy of these conditions is sent to the Customer at the same time as the sending of his reservation confirmation; he cannot claim not to have been aware of it.

A natural person is present locally and has the mission in particular to ensure the good maintenance of the house, its proper functioning, the reception services, certain à la carte services. A practical guide, including among other safety instructions, is available in paper format, and can be sent in PDF format on request before the start of the stay.

The Customer undertakes to read these General Conditions of Sale when entering the premises.

The contractual relations between the Customer and LA VARENNE SAS fall under the regime for seasonal rentals of furnished tourist accommodation as defined by law 70-9 of January 2, 1970 and DO NOT IN ANY WAY APPLY TO THE SUPPLY OF HOTEL SERVICES.

ARTICLE 1: OBJECT

The purpose of these General Conditions is to determine the conditions under which LA VARENNE SAS undertakes to provide the Accommodation Services within La Petite Varenne, namely a number of nights, a number of people, provided by the Customer when of the reservation and confirmed in an e-mail.

In any case, and for any reason whatsoever, the Customer is prohibited from exceeding the total capacity of the house indicated on the site. If for any reason it does not comply with this obligation, LA VARENNE SAS reserves the right to refuse to accommodate excess persons and to simply cancel the accommodation services.

ARTICLE 2. ACCOMMODATION PROVISION

2.1 Services included in the Accommodation Service

The Accommodation Service provided consists of the provision of the house and the various “included” equipment and services described on the website, offered for the number of nights and occupants specified by the Customer when booking, and especially :

• A welcome, by appointment or an indication of where to find the keys to the house in the event of late arrival or no appointment;

• The provision of equipped rooms in the house such as living/dining room, kitchen, bedrooms, bathrooms;

• The supply of household linen (sheets and towels), depending on the duration of the stay;

• A list of equipment mentioned on the website.

The photographs presented on the website are not contractual. Even if all the best efforts are made so that the photographs, graphic representations and the texts reproduced to illustrate La Petite Varenne give as accurate an overview as possible of the places and their level of service, variations may occur between the day of the consultation of the website and the day the service is consumed.

2.2 Arrival – Departure

2.2.1 Arrival

The arrival of Occupants takes place between 3 p.m. and 7 p.m., by appointment.

They are welcomed and the facilities made available to them are presented to them and their operation explained; the practical guide to the house and the keys giving access to the Petite Varenne are also given to them.

The contact details of the person present on arrival are communicated to the Customer by e-mail 30 days before the scheduled arrival date, if the reservation is made more than 30 days in advance, and on the day of the reservation if the delay remaining until the scheduled arrival date is less than 30 days.

The person present at the arrival not residing on site, the Customer is asked to offer her a precise meeting time (with a tolerance of more or less 30 minutes) at the latest 24 hours in advance at the within the ranges referred to above.

Outside the 3 p.m. to 7 p.m. time slot, the keys will be made available in a secure safe with access code located outside the house. In this case, the Customer may, if he wishes, request for himself or for the occupants an appointment the following day.

Upon arrival in the house, the Customer agrees to read the practical guide to the house, made available to him in the reception binder.

He has 24 hours after his arrival to report the presence of an affected or damaged item, or any malfunction or breach.

Failing this, in the event of a subsequent dispute about the existence of damage, malfunctions or deterioration affecting the house, its furniture or equipment, it is stipulated that the latter will be deemed to have been made available in perfect condition on the date of arrival and that no dispute may be issued by the Customer if LA VARENNE SAS, by way of compensation, were to make a deduction taken from the security deposit.

2.2.2 Departure

On the day of departure, the stay ends at 11 a.m., time at which the Occupants must leave the house, except on Sundays when a later departure is authorized, in agreement with the person making the reservations.

In the event of departure after this time, unless expressly agreed by the person making the reservations, the price of a “late departure” will be deducted from the amount of the security deposit, corresponding to one night for the whole of the House.

If an undue stay in the premises continues beyond, the total price of the stay of the next Customer will be deducted as compensation, to which will be added the amount of any compensation.

The client/occupants agree to hand over the keys to the house either directly to the person responsible for departure, or in the secure safe with access code located outside the house.

In all cases, an exit inventory will be carried out, by appointment.

If the keys are not returned under the conditions provided for in the paragraph above, a lump sum of 100 euros will be deducted from the security deposit as compensation for the non-return of the keys.

ARTICLE 3. RESERVATION AND FINANCIAL CONDITIONS

3.1 Booking process

The reservation is made on the website by the following process:

• Indication of the date of arrival, the date of departure;

• Indication of the number of occupants within the upper limit of the maximum capacity of the house announced on the website;

• Information of the Customer’s contact details;

• Entering the Customer’s bank details;

• Consultation and acceptance of these General Conditions before validation of the reservation;

• Validation of the reservation by the Customer;

• Sending the booking confirmation by email to the Customer.

The Customer undertakes to complete all the information requested when booking and certifies the veracity and accuracy of the information provided.

The reservation is deemed accepted by LA VARENNE SAS when the reservation confirmation is sent by e-mail summarizing the number of nights, the number of people, the dates and times of arrival and departure scheduled, the price to be paid; an invoice can be issued to the customer on request.

The arrival date indicated on the booking confirmation corresponds to the date indicated by the Customer and will be the start date of the stay.

The Customer has a period of 48 hours from the confirmation of the reservation to report any error relating to the terms and conditions thereof (excluding reservations made less than 72 hours before entering the premises).

In the absence of dispute and after this period, the reservation will be deemed accepted by the Customer.

30 days before the scheduled arrival date, LA VARENNE SAS will send an e-mail indicating, among other information, the contact details of the person present on arrival.

3.2 Booking and cancellation conditions

3.2.1 Customer quality

A Customer with a disability or incapacity must inform LA VARENNE SAS and indicate, upon booking, any special needs arising therefrom. LA VARENNE SAS will make its best efforts to take all appropriate measures, whenever possible, it being specified that full and total coverage of the handicap or incapacity is the responsibility of the Customer and is his sole responsibility.

The Service is reserved for adult Customers (over 18 years old). LA VARENNE SAS cannot accept the registration of a minor. Consequently, he cannot be blamed for not performing the agreed Accommodation Services in the event that, despite this prohibition, a minor has made a reservation on the website. Such an action would be considered as a fault on the part of the Customer exonerating LA VARENNE SAS from its liability.

Similarly, the adult Customer agrees not to leave minor occupants in the house outside his presence or that of other adults.

3.2.2 Booking conditions

The reservation of a stay requires the entry by the Customer on the website, of a valid credit card number, and the visual cryptogram.

The process will go as follows:

• A sum equal to 25% of the total amount of the stay will be debited when booking;

• A sum equal to 75% of the total amount of the stay will be debited 30 days before arrival. In case of late booking (less than 30 days before arrival), the full amount of the stay will be due at the time of booking.

The same credit card as the one used for the reservation will be used for the payment of the two installments.

The customer has a withdrawal period of 24 hours from the sending of the confirmation, allowing him to cancel his reservation free of charge.

3.2.3 Cancellation conditions

– Cancellation no later than 30 days before the date of arrival:

The Customer may cancel his reservation no later than thirty (30) days before the Arrival Date, by email.

LA VARENNE SAS will then be obliged to cancel the reservation and the sum of 25% debited at the time of the reservation will be immediately returned to the Customer by crediting the card used for payment.

– Cancellation between 29 and 15 days before the date of arrival:

In the event that the Customer cancels his reservation between twenty-nine (29) days and fifteen (15) days before the date of arrival, by e-mail, LA VARENNE SAS will retain the deposit of 25 % of the total amount of the stay paid by the Customer when booking.

– Cancellation between 2 p.m. and the day before the arrival date:

In the event that the Customer cancels his reservation between fourteen (14) days and one (1) day before the date of arrival, by email, the total price of the reserved stay will be due.

3.2.4 No-show

In case of no-show, the total price of the booked stay will be due.

3.2.5 Modification of Accommodation Services

Any modification of the reservation, whether in particular the duration of the stay or the dates, can only be processed by contacting customer service (contact form) who will do their best to respond to the change request.

3.3 Fault of the customer in the booking process

Any reservation or payment that is irregular, ineffective, incomplete or fraudulent for a reason attributable to the Customer or his bank will result in the cancellation of the reservation at his expense, without prejudice to any civil or criminal action against him.

The Customer must necessarily have a valid and active e-mail address and must ensure that his e-mails are received correctly.

In the event that the Customer transmits incorrect contact details in one of the stages of the reservation, LA VARENNE SAS cannot be held liable and any levity or negligence on the part of the Customer in this respect cannot be attributed to the latter. Acceptance of these General Terms and Conditions of Sale implies express and irrevocable acceptance of the use of electronic media as a means of communication and conclusion of the contract binding the Customer to LA VARENNE SAS. In this respect, the Customer is solely responsible for regularly consulting his e-mail box.

Except in cases of fraud, of which it would be up to him to provide proof, the Customer is financially responsible for his actions on the website, in particular for the use that would be made of his username and password. It also guarantees the truthfulness and accuracy of the information provided by itself on the website.

Fraudulent use of the website, or which contravenes these General Terms and Conditions of Sale, would justify the Customer being refused access to booking a stay at any time.

ARTICLE 4. PRICE AND PAYMENT

4.1 Price of the stay

An indicative minimum price is mentioned on the website, and expressed in nights.

The total amount due by the Customer at the time of his reservation is communicated following the reservation request and corresponds to the rate in force on the date of reservation of the night for the period corresponding to the desired date and multiplied by the duration of the stay expressed in number of nights, taking into account decreasing rates if applicable.

This amount appears on the booking confirmation email.

This price is inclusive of VAT and includes tourist taxes.

It is payable in euros.

The prices calculated on the website are only valid for the duration and period indicated. Rates and conditions may be modified without notice depending on the situation and requirements.

4.2 Payment for the stay

Payment is made by credit card (Visa, MasterCard, American Express, etc.).

4.3 Security deposit

A security deposit (not debited) will be requested on the day of arrival on the premises, payable by check. This security deposit may cover the sums owed by the Customer to LA VARENNE SAS in respect of:

• Repairs or damage caused and/or broken or missing objects reported to LA VARENNE SAS and to the Customer by the person present at the time of departure (check-out inventory) or within 24 hours after the date of his departure. departure or that of the occupants,

• And more generally any direct or indirect damage caused by an Occupant during his stay.

These sums will be deducted from the amount of the security deposit within a period not exceeding 30 days.

The amount of the security deposit is set at: one thousand euros (€1,000).

ARTICLE 5. A LA CARTE SERVICES

LA VARENNE SAS offers its Customers the possibility of benefiting from an “à la carte” cleaning service during their stay offered on the website. This service will be charged when booking. This à la carte service may be temporarily interrupted, in particular for holiday periods.

ARTICLE 6. INSURANCE

The tenant is required to insure the rented premises. He must check if his main housing contract provides for the resort extension (holiday rental). Otherwise, he must intervene with his insurance company and claim the extension of the guarantee or take out a special contract, under the “holiday” clause. A certificate of insurance will be requested when entering the premises.

ARTICLE 7. CUSTOMER OBLIGATIONS

The Customer and/or the Occupants use the equipment and facilities of the house made available to them under their sole and entire responsibility.

The Customer and/or the Occupants are required to use the equipment and facilities of the House as a good father.

The Client is responsible for the respect of these obligations by the occupants.

In this respect, the Customer and/or the Occupants are required:

• not to make any changes to the layout of the House and the furniture or equipment furnishing it, to use all the equipment made available only for the use intended for them;

• not to exceed the maximum number of Occupants authorized in the house.

• to allow peaceful enjoyment of the common parts and facilities of the house if there are any by all of its occupants, and as such, in particular, to comply with anti-smoking regulations, to preserve the tranquility of the premises, and to leave the common areas clean and tidy after use.

The Customer will be given a set of keys allowing access to the House. It will be up to him to return it to the person present at the time of departure or to put it back in the secure safe provided for this purpose on the date of departure.

The Customer accepts in advance the interventions of service providers designated by LA VARENNE SAS which would be necessary for the proper functioning of the house during the duration of the stay.

ARTICLE 8. PERSONAL DATA

LA VARENNE SAS may need to collect personal data. Personal data means all information disclosed by users via forms – as natural persons – whatever their nature such as their surname, first name, e-mail, date of stay, location, allowing them to be identified directly or not that they are provided voluntarily by them or collected as part of their navigation on the service.

The information collected during your reservation is intended for LA VARENNE SAS for the following purposes: sending the confirmation of availability, sending the reservation confirmation, sending a reminder of the itineraries, personalizing your reservation and invoice.

They are kept indefinitely in our database, in order to meet legal obligations in the event of control by the Chamber of Commerce or tax services, as well as for analytical purposes, to recognize you during a future visit. This personal information collected about the user is intended for LA VARENNE SAS. Such information may be copied, used and or archived and may not be disclosed to third parties unless requested by law or any judicial authority.

In application of the applicable regulations (Law n ° 78-17 of January 6, 1978 relating to data processing, files and freedoms as well as the regulations for the protection of personal data) you have a right of access, rectification , deletion, opposition, portability and the possibility of defining directives relating to the fate of your data after your death. ARTICLE 9. ELECTRONIC SIGNATURE

The entry of the required bank information, as well as the acceptance of these general conditions of sale and the reservation request, constitute an electronic signature which has, between the parties, the same value as a handwritten signature.

ARTICLE 10. CONVENTION OF PROOF

The acceptance of these general conditions of sale and the reservation request constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.

ARTICLE 11. RESPECT FOR PRIVACY

The information requested from the Customer is necessary for the processing of his reservation and will be communicated to all stakeholders and partners, except for bank information. In the absence of information, LA VARENNE SAS will not be able to register a reservation.

Unless the Customer objects, LA VARENNE SAS may send them a satisfaction questionnaire by e-mail following their stay.

ARTICLE 12. NON-WAIVER CLAUSE

The fact for LA VARENNE SAS to temporarily waive one of the rights arising from these General Terms and Conditions of Sale does not in any way imply a definitive waiver of this right or of any other right or prerogative recognized by said General Terms and Conditions of Sale.

ARTICLE 13. ENTIRETY

These general conditions of sale express the entirety of the obligations of the parties. No general or specific condition suggested or communicated by the customer can be integrated into these general conditions. The documents forming the contractual commitments between the parties are, in ascending order of priority, the booking confirmation, the practical guide to the house and these general conditions of sale.

ARTICLE 14. FORCE MAJEURE

LA VARENNE SAS cannot be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, either by third parties or by the customer, in particular the unavailability of the house for technical reasons. or climatic, the unavailability of the Internet network, the impossibility of access to the website, an external intrusion, a computer virus, or in the event of prepayment not authorized by the cardholder’s bank.

These General Conditions of Sale are governed by French law.

Only the Courts of the jurisdiction of the place of the building object of the rental are competent.
